Video surveillance in company premises is subject to strict legal requirements, which every employer must observe to avoid violating the personality rights enshrined in the German Basic Law (Grundgesetz, GG). In Germany, every individual has a right to their own image. When recording on company property or within a business, this right is necessarily restricted, meaning clear prior notice must usually be provided. Employees, customers, suppliers, and visitors must be informed upon entering the premises that continuous video surveillance is in operation. Consequently, offenders will avoid committing crimes in areas under visible surveillance, making it ineffective for evidence gathering.

 

Hidden camera installations remain the only viable method for gathering proof. These are permissible only when temporary and proportionate, and when no less intrusive measures—such as surveillance by our Hamburg detectives or undercover employee placement—would achieve the desired results.

Legal Limits of Video Surveillance

Under the Federal Data Protection Act (BDSG), video surveillance is only considered lawful when necessary and proportionate, and when no alternative monitoring method is feasible. Even then, there are strict limitations: surveillance of private areas such as toilets, showers, or changing rooms violates the right to privacy. Audio recording is also prohibited, as it infringes § 201 of the German Criminal Code (StGB) on the confidentiality of spoken communication.

Video Surveillance in Private Spaces

In private properties, the regulations are even stricter. In December 2014, the European Court of Justice fined a homeowner who had installed cameras on his property after repeated break-ins. Although a burglar was identified and convicted based on the recordings, the same burglar successfully sued the homeowner, arguing that he had been unlawfully filmed. The court ruled in favour of the intruder. This demonstrates that a property owner may not surveil the entire premises if passersby could be recorded, and proper warning signs must be posted at the property boundary. The Court reasoned that the burglar would have abandoned the attempt had he known he would be filmed, as no offender voluntarily consents to recording.
